The Sample Forms offered on this website are NOT intended to act as legal advice. If you decide to use these forms in your own foreclosure case, please be aware that you STILL NEED to seek the advice of a housing counselor (you can obtain the name of a counselor by dialing 2-1-1 or 216-436-2000) and/or an attorney.

As with all official paperwork, you should remember to keep a copy of every form that you file with the Court, or send to the attorney for the other side.

The “Motion for Additional Time in Which to Answer or Respond to Plaintiff’s Complaint”  is used when you need the Court to give you more time in your case to either: file the necessary documents with the Court; get advice from a Housing Counselor; take your case to an attorney; or negotiate with your lender. If you file this with the Court, your case is NOT OVER. You are STILL being sued by your lender (or servicer) because you haven’t paid your mortgage. Do NOT ignore your case after you file this Motion for Additional Time.

Motion for Additional Time

The “Request for Documents” is NOT to be filed with the Court. This is to be used ONLY if you (or your housing counselor or attorney) needs to review your loan documents. If you need your loan documents, send this form to the attorney for the lender/servicer, not the Court.

Request for the Closing Documents

The “Motion to Stay Confirmation of Sale” is used AFTER the Sheriff’s sale takes place to ask the Court for more time, before the bank tries to evict you. This MUST BE FILED within 7 days after the Sheriff’s Sale. If you file this motion DO NOT assume that you automatically have an additional 30 days. You should still be trying to find a new place to stay, if you are still in the home by the time the Sheriff’s Sale occurs.
